Booking Conditions

Please read these Terms and Conditions carefully before purchasing a ticket.

By purchasing a ticket from Money Hunt, you agree to be bound by these Terms and Conditions. These Terms and Conditions relate both to the sale of tickets and attendance at events. These Terms and Conditions apply to both the original purchaser and any subsequent ticketholders.

 

Variation to Terms and Conditions

Money Hunt may vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after these Terms and Conditions have been updated.

 

General Terms and Conditions

Money Hunt’s liability in connection with tickets or events are limited to the extent required by law (including the Australian Consumer Law).

‘Money Hunt’ when used in this document refers to the organisers of the Money Hunt event, registered legally as Winking Owl Learning Pty Ltd.

 

Assumption of risk and Waiver of liability

By registering, you understand that there are one or a combination of inherent risks involved in outdoor recreational games such as Money Hunt. These risks may include but are not limited to: 1) contact or collision with persons or objects (e.g., collision with spectators or course personnel), contact with other participants, contact or collision with motor vehicles or machinery, and contact with natural or man-made fixed objects or obstacles); 2) encounter with obstacles (eg. road and surface hazards); 3) equipment related hazards (e.g., broken, defective or inadequate competition equipment); 4) weather-related hazards (e.g., extreme heat, extreme cold, humidity, ice, rain, fog); 5) inadequate first aid and/or emergency measures; 6) judgment and/or behaviour-related problems (e.g., erratic or inappropriate co-participant or spectator behaviour, errors in judgment by personnel working the event; 7) natural hazards (e.g. uneven terrain, rock falls, lightning strikes, earthquakes, bushfire, wildlife attacks, contact with poisonous plants, marine life and/or ticks); 8) security related incidents (eg. terrorist attack). You understand that not all risks can be predicted and that you may face harm (including the risk of death or personal injury) by taking part.

You are aware that the game is self-guided and predominantly played without physical supervision from Money Hunt organisers. You are aware that participating in Money Hunt may involve some level of moderate to heavy physical exertion, and that it is your responsibility to ensure that your level of fitness is suitable to the level of physical exertion you assume. You understand that if you fail to provide relevant information about your health and capabilities, including any pre-existing or previous injuries or medical conditions that may either affect you or any participant’s safety or that may be exacerbated by participation in the course and that if you fail to provide this information, the staff will not be able to take appropriate action to limit the risk of harm to yourself. You warrant that you will not participate in the activity whilst affected by drugs and alcohol, and that participation after the consumption of drugs or alcohol will remove any and all liability and responsibility from Money Hunt staff.

You assume all risks outlined in this document (and other risks that may not be predicted) and agree to waive all liability claims against Money Hunt in relation to any form of injury or death arising out of these risks. You will not hold Money Hunt, their employees or agents legally responsible for any injuries you suffer. You will not sue Money Hunt, their employees or agents for any claims, costs, damages or liabilities you may have for injuries suffered by you. You understand that this waiver represents a legal release and discharge of legal responsibility to Money Hunt, their employees or agents and is provided in consideration for participation in a Money Hunt event.

If you participate in Money Hunt, your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in this notice. The change to your rights, as set out in or on this notice, does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

 

Refunds, exchanges and replacements

Money Hunt will only offer a refund or exchange of a ticket if an event is cancelled, rescheduled or significantly relocated (and you cannot or do not wish to attend the rescheduled or relocated event), or to the extent otherwise required by law (including the Australian Consumer Law). You must apply for a refund within a reasonable time. Money Hunt does not offer refunds or exchanges as a result of a change in your personal circumstances.
If an event is cancelled, rescheduled or significantly relocated, all liability is limited to the amount for which the ticket was purchased (including any fees or charges). Proof of purchase may be required for any refund or exchange. Unless required by law (including the Australian Consumer Law), Money Hunt will be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.

Money Hunt will only replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket can be verified, including proof of purchase, and if you give reasonable notice before the event. Money Hunt may charge a reasonable fee for the replacement of tickets.

You should carefully consider the refund and cancellation policies of travel, accommodation and other goods or service providers when making arrangements for attendance at an event. You may also wish to consider taking out a relevant insurance policy to cover for any losses in the event of cancellation, rescheduling or relocation.

 

Variations to events

Money Hunt reserves the right to add, withdraw, reschedule or vary advertised programs, prices, venues, and booking capacity.

 

Conditions of entry

Admission to an event is subject to Money Hunt’s Terms.

You may be denied entry into, or removed from, an event where Money Hunt has reasonable grounds to do so, including if you breach these Terms and Conditions, or you are intoxicated, under the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of the event by others. You may be required to submit to a search of your person and/or possessions before entering the event.

 

Authenticity and validity of tickets

Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from Money Hunt or other authorised points of sale.

 

Electronic ticketing

It is your responsibility to print out the electronic ticket which will be sent to your email upon registration, or to download the ticket in a mobile device in such a way that it may be viewed upon entry.

 

System Errors

While Money Hunt takes all reasonable care to ensure that tickets are correctly priced and only available for sale when intended, sometimes errors may occur. Money Hunt may cancel an order made as a result of any such error, although in the case of a pricing error Money Hunt will endeavour to contact you to give you the option of purchasing the ticket at the correct price.

 

Customer Errors

If an error on your behalf results in Money Hunt reprocessing the ticket transaction at your request, Money Hunt may charge to you the actual costs incurred in reprocessing the ticket transaction, including any chargeback or postage fees charged to Money Hunt by a third party.
